Protect the Brand You've Worked Hard to Build

Frequently Asked Questions

Do I need a trademark before starting my business?

Not necessarily, but conducting a trademark search early can help avoid investing in a brand that may later require rebranding.

Can I register just my business name?

Yes, provided it functions as a trademark and meets federal registration requirements.

Do I need a trademark if I already have an LLC?

Yes. Forming an LLC and obtaining a trademark serve different legal purposes. An LLC establishes your business entity, while a trademark protects your brand identity.

Does registering a domain name give me trademark rights?

No. Registering a domain name or a state business entity protects your URL and corporate registration, but does not grant trademark rights. If your domain name infringes on a federally registered trademark, you can legally be forced to surrender it.

Can I trademark a word or phrase to stop anyone from saying it?

No. A trademark is not legal ownership of language. It only stops competitors from using a similar name or mark in a way that creates consumer confusion within the same industry.

How long does trademark registration take?

Federal registration typically takes several months and may take longer depending on examination, Office Actions, and any opposition proceedings.

What is the difference between a trademark and a service mark?

A trademark identifies and protects the source of physical goods (e.g., Apple computers or Chanel perfume). A service mark identifies the source of intangible services (e.g., Google's search algorithms or television entertainment services). Both receive the exact same legal protections.

Can an attorney handle my trademark registration if they are located out-of-state?

Yes. Because trademark registration is handled at the federal level through the USPTO, a licensed attorney can represent you regardless of which state you or your business are located in.
